Battery is the touching or striking of a person against the will or without the consent of that person.A battery is a misdemeanor and is punishable by both probation or jail but the sentence can not exceed one year. Felony Battery is a battery with the additional element that the person committing the battery has been previously convicted of a battery. This offense is a felony of the third degree and carries a maximum punishment of 5 years in prison, probation or both.
